1. About these terms

These terms govern your use of exacapital.ae (the “site”), operated by EXA Capital DMCC, a free zone company registered in the Dubai Multi Commodities Centre under Licence No. DMCC-883542 and Registration No. DMCC190950.

By using the site you accept these terms. If you do not accept them, please do not use the site.

2. The site is information only

The site describes EXA Capital, our investment approach and our portfolio. It is provided for general information. It is not an offer, an invitation, a recommendation or advice of any kind, and it must not be relied on in making any investment or business decision. Please read our Disclaimer, which forms part of these terms.

3. Permitted use

You may view, download and print material from the site for your own information and internal business use. You must not:

• copy, republish, distribute or commercially exploit any part of the site without our written permission;
• use the site in any way that is unlawful, fraudulent, or harmful, or in connection with any unlawful activity;
• attempt to gain unauthorised access to the site, its server, or any connected system or network;
• introduce any virus, malware or other harmful material;
• use automated systems to scrape, harvest or extract data from the site in a way that imposes an unreasonable load on our infrastructure, or that is used to compile a database or to contact individuals named on the site without their consent;

4. Intellectual property

All content on the site — including text, images, video, graphics, layout, design and the EXA Capital name and logo — is owned by us or licensed to us and is protected by intellectual property laws. Names, logos and trade marks of portfolio companies, partners and other third parties belong to their respective owners and appear on the site for identification only. Nothing on the site grants you any licence or right to use any such mark.

5. Accuracy and availability

We take care in preparing the site, but we do not warrant that its content is accurate, complete or current. Information about our portfolio and activities reflects the position at the time of publication and may change without notice. We may modify, suspend or withdraw all or any part of the site at any time and without notice, and we are not liable if it is unavailable at any time or for any period.

6. Third-party sites

The site links to websites operated by portfolio companies, partners and other third parties. We do not control those sites, do not endorse their content, and accept no responsibility for them or for any loss arising from your use of them. Following an external link is at your own risk and subject to that site’s own terms and privacy policy.

7. Limitation of liability

To the fullest extent permitted by law, the site is provided “as is” and “as available”, and we exclude all warranties, conditions and representations, whether express or implied.

To the fullest extent permitted by law, we will not be liable for any loss of profit, loss of business, business interruption, loss of anticipated savings, loss of data, or any indirect or consequential loss arising out of or in connection with your use of, or inability to use, the site or any content on it.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or the site, are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. The courts of Dubai have exclusive jurisdiction.
